This settlement came after a judge ruled that the resale platform had been selling counterfeit sneakers for more than six months. The settlement immediately canceled the jury trial scheduled for October and dismissed all claims with prejudice. This move relieved StockX of the risk of an adverse ruling and allowed Nike to avoid the uncertainty of putting its brand protection strategy before a jury. The case, filed in the Southern District Court of New York in February 2022, involved Nike accusing StockX of trademark infringement and dilution, claiming that its "Vault" NFTs used unauthorized imagery of Nike sneakers to sell tokens associated with the physical shoes.
